1. Agreement
By downloading, installing or using CineKeep, or by using cinekeep.net, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the app or site.
The operator of CineKeep (“CineKeep”, “we”, “us”) is the licensor. Contact: legal@cinekeep.net · Support: support@cinekeep.net · Website: https://cinekeep.net
Insert the legal entity name, postal address and telephone number here before store submission if your counsel requires a registered operator on the EULA.
2. Acknowledgement — Apple (minimum EULA term)
You and CineKeep acknowledge that these Terms are concluded between you and CineKeep only, and not with Apple Inc. or its subsidiaries (“Apple”). CineKeep, not Apple, is solely responsible for the CineKeep licensed application and the content thereof.
3. Scope of license — Apple (minimum EULA term)
CineKeep grants you a limited, non-exclusive, non-transferable, revocable license to use the iOS/iPadOS application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the application may be accessed and used by other accounts associated with you via Family Sharing, volume purchasing or Legacy Contacts where Apple allows it.
For Android, CineKeep grants you a limited, non-exclusive, non-transferable, revocable license to use the application on devices you own or control, as permitted by the Google Play Terms of Service.
You may not rent, lease, lend, sell, redistribute or sublicense the application. You may not copy (except as permitted by this license and the Usage Rules), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the application, except to the extent that such restriction is prohibited by applicable law or by the licensing terms of open-source components included in the application.
4. What CineKeep provides
CineKeep is a streaming guide. It shows information about movies and series and where they may be available to stream, rent or buy in a selected country. CineKeep:
- does not host, stream, download or play audiovisual content;
- does not replace a subscription to Netflix, Prime Video, Disney+, Max, Hulu, Apple TV+, or any other service;
- is not affiliated with, endorsed by or sponsored by those services, TMDB, or Movie of the Night beyond the licensed use of their APIs and required attribution;
- may deep-link you into a third-party app or website. Your use of that third-party service is solely between you and them.
5. Data sources and accuracy
CineKeep uses only two catalog services:
- TMDB for titles, images, cast, ratings and trailers. This website and this application use TMDB and the TMDB APIs but are not endorsed, certified, or otherwise approved by TMDB. TMDB Content is not cached longer than six months. You must not scrape, resell, sublicense or use TMDB data to train AI. TMDB’s API Terms apply to our use of that API: themoviedb.org/api-terms-of-use.
- Streaming Availability API by Movie of the Night for where to watch. That data is shown only to CineKeep’s end users. We do not resell, reshare or export it to other businesses. Required notice: streaming availability information is provided by Streaming Availability API by Movie of the Night (movieofthenight.com/about/api). MotN is not responsible for catalog mistakes.
Catalogs change constantly. We and those providers do not warrant that a title is available, that a deep link will open, or that ratings or synopses are complete or appropriate for every viewer. Always confirm in the official streaming app before you rely on a listing.
6. Your responsibilities
You agree that you will:
- use CineKeep only for personal, lawful purposes;
- not attempt to disrupt, probe or overload the app, this website, or our API providers;
- not use CineKeep to find or promote unauthorized copies of films or shows;
- comply with the terms of any streaming service, wireless carrier, or other third party whose services you use together with CineKeep (Apple minimum EULA term: third-party terms of agreement);
- not represent that CineKeep is an official app of any streaming platform.
7. Price — free worldwide
CineKeep is free to download and use. There are no advertisements in the app, no in-app purchases, and no subscriptions. “Free” is not a trial. Availability of the guide does not depend on paying CineKeep. You may still need a paid subscription to a third-party streaming service in order to play a title there — that contract is between you and that service, not CineKeep.
The app and this website are intended for users worldwide, including the United States and the European Economic Area, to the extent Apple and Google make the app available on those storefronts.
8. Maintenance and support — Apple (minimum EULA term)
CineKeep, not Apple, is solely responsible for providing any maintenance and support with respect to the licensed application, whether under these Terms, applicable law, or otherwise. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the licensed application.
Support is offered via cinekeep.net/support and support@cinekeep.net. Google likewise is not obligated to provide support for CineKeep.
9. Warranty disclaimer — Apple (minimum EULA term)
The application and website are provided “as is” and “as available”. To the maximum extent permitted by law, CineKeep disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of catalog data, and non-infringement.
If the licensed application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the licensed application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the licensed application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be CineKeep’s sole responsibility. The same refund path for Android purchases, if any, is through Google Play under Google’s policies, except where consumer law says otherwise.
Nothing in these Terms limits any non-waivable consumer guarantee in your country of residence (including EU/UK statutory rights and Australian Consumer Law).
10. Product claims — Apple (minimum EULA term)
You and CineKeep acknowledge that CineKeep, not Apple, is responsible for addressing any claims by you or any third party relating to the licensed application or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the licensed application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the licensed application’s use of the HealthKit or HomeKit frameworks (CineKeep does not use HealthKit or HomeKit).
11. Intellectual property — Apple (minimum EULA term)
You and CineKeep acknowledge that, in the event of any third-party claim that the licensed application or your possession and use of it infringes that third party’s intellectual property rights, CineKeep, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
CineKeep, the bookmark-screen mark, and the site design are our intellectual property. TMDB, Movie of the Night, Netflix, Prime Video, Disney+, Max, Hulu, Apple, Google and other names and marks belong to their owners. We use those names only to identify where a title may be watched (nominative fair use / equivalent local doctrines). No license to those marks is granted. We do not use unofficial streaming-service logos. Poster and still images are provided by TMDB under their API terms and remain the property of their respective rights holders. CineKeep does not host films, does not authorise copying of films, and is not a source of pirated streams. If you believe content on the site infringes copyright, write to legal@cinekeep.net with enough detail for us to identify it.
12. Legal compliance — Apple (minimum EULA term)
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with other export and sanctions laws that apply to you.
13. Developer contact — Apple (minimum EULA term)
Questions, complaints or claims with respect to the licensed application should be directed to:
CineKeep
Email: support@cinekeep.net
Privacy: privacy@cinekeep.net
Web: https://cinekeep.net/support
Add telephone number and postal address here before using these Terms as a custom App Store EULA if Apple review requires them.
14. Third-party beneficiary — Apple (minimum EULA term)
You and CineKeep acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
15. Google Play
If you obtained the application from Google Play, you also agree to the Google Play Terms of Service. In the event of a conflict between those terms and these Terms concerning Google’s role as the store operator, Google’s terms govern that role. These Terms are between you and CineKeep, not Google.
16. Privacy
Our handling of personal data is described in the Privacy Policy, which is incorporated by reference. You can request deletion of personal data we control as explained there and on the Support page.
17. Acceptable use of the website
You may not attack, scrape at a volume that impairs, or misrepresent the site. Content on the marketing site is for information. Features described as “we will ship” are the intended product; availability in a given store build may lag the spec.
18. Limitation of liability
To the maximum extent permitted by law, CineKeep and its officers, contractors and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or catalog inaccuracy, even if advised of the possibility. Because CineKeep is free, our total liability for any claim arising out of the app or site is limited to USD 50, except where a non-waivable law requires a higher floor. This does not exclude liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited in your jurisdiction (including some US states that do not allow certain warranty disclaimers).
19. Termination
These Terms apply until terminated. Your rights terminate automatically if you breach them. You may stop using the app at any time and uninstall it. Sections that by nature should survive (including licence restrictions, IP, disclaimers, liability limits, Apple beneficiary clause, and governing law) survive termination.
20. Governing law and disputes
If you are a consumer, mandatory consumer protection laws of your country or state of residence apply and you may bring proceedings in the courts of that place. EU/EEA and UK consumers also keep the right to use the European Commission ODR platform or the UK equivalent while those mechanisms exist.
Subject to those mandatory rights, and except where prohibited, these Terms are governed by the laws applicable in your place of residence, without regard to conflict-of-law rules. Nothing in this section deprives you of non-waivable local rights.
We do not require arbitration or a class-action waiver. If a future version adds either, it will not apply to consumers in jurisdictions that forbid them, and it will be described clearly before you agree.
21. Changes
We may update these Terms. The date above will change. If a change is material, we will post it on this page. If store rules require additional EULA language, we may add it. Your continued use after the effective date constitutes acceptance to the extent permitted by law.
22. Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and CineKeep for the app and site, and supersede prior terms for the same subject. If a provision is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver.
